What is Chapter 7 Bankruptcy?
Chapter 7 bankruptcy is often referred to as liquidation bankruptcy because a trustee must collect all non-exempt assets (properties deemed non-essential to living) and then sell them to repay all or a majority of the debts. The State of Georgia requires that you participate in credit counseling prior to filing for Chapter 7 bankruptcy. You must prove that you received credit counseling from an agency approved by the U.S. Trustee in Georgia within 6 months before you file. You must also complete the bankruptcy petition, multiple other mandatory forms, and file said forms in the appropriate Georgia bankruptcy court. In addition, a means test is required.
Qualifying for Chapter 7 Bankruptcy - The Means Tests
A means test compares your income to the median household income of your size in Georgia. If your income is less than the median, you will qualify for Chapter 7 bankruptcy. If your income is over the median income amount, you may still be able to file—but you must provide detailed information regarding your expenses and payments relating to secured debts. Depending on the types of debt that you owe and the results of your means test, filing for Chapter 13 bankruptcy may be more beneficial for you.
